ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH OUR SERVICES IS ACCESSED AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO OUR SERVICES WILL NOT EXCEED THE AMOUNT YOU HAVE PAID US, IF ANY, FOR ACCESSING OR USING OUR SERVICES DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE DATE OF YOUR CLAIM.

THE LIMITATIONS OF LIABILITY IN THIS SECTION APPLY TO ALL CLAIMS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY.

You agree to indemnify, defend, and hold harmless Botoxsucd and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that arise from or relate to: (a) your use of our Services; (b) your violation of these Terms; (c) your violation of any rights of another; or (d) your conduct in connection with our Services.

11. Term and Termination

These Terms will remain in full force and effect while you use our Services. We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason, including but not limited to your breach of these Terms. Upon termination of your access to our Services, all provisions of these Terms that by their nature should survive termination will survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

12. Governing Law and Dispute Resolution

These Terms will be governed by and construed in accordance with the laws of Ghana, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or our Services will be resolved exclusively through binding arbitration in Accra, Ghana, in accordance with the rules of the Ghana Arbitration Centre. The arbitration will be conducted in English by a single arbitrator. The arbitrator's award will be final and binding and may be entered as a judgment in any court of competent jurisdiction.

13. Miscellaneous

These Terms constitute the entire agreement between you and Botoxsucd regarding your use of our Services and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning our Services. If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent possible, and the other provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. We may assign our rights and obligations under these Terms to any party at any time without notice to you. You may not assign your rights or obligations under these Terms without our prior written consent.
